Michael Nanos and Joseph Micallef v. The Corporation of the City of Cambridge (Court File No. CV-24-00000-526-0000)
On March 18, 2024, a Notice of Eviction was served to residents of the Branchton Road encampment by the City of Cambridge. Our team at Waterloo Region Community Legal Services filed an injunction on behalf of two residents living at the encampment. WRCLS also filed a Statement of Claim alleging that the by-law in question violated the Charter rights of the Plaintiffs, as well as claiming for general damages for loss of property and punitive damages against the City of Cambridge.
On May 8, 2024, the City of Cambridge decided to rescind their eviction notices against the residents at the encampment. WRCLS applauds this decision and going forward, we welcome an opportunity to work with the City of Cambridge on the issue of a human rights-based approach to homelessness and encampments. The parties are currently working to settle the underlying cause of action.
